1. Acceptance of Terms

By downloading, installing, or using any application published by Phyx Games ("we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use our apps.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our apps for personal, non-commercial purposes on devices you own or control, subject to these terms and the rules of the applicable platform store (Apple App Store, Google Play Store, or other distribution platforms).

You may not:

• ●Copy, modify, distribute, sell, or lease any part of our apps.
• ●Reverse-engineer, decompile, or disassemble our apps, except where applicable law expressly permits it.
• ●Use our apps for any unlawful or unauthorized purpose.
• ●Remove, alter, or obscure any proprietary notices in our apps.

3. User-Created Content

Some of our apps allow you to create content (such as custom word packs or game configurations). You retain ownership of any content you create. This content is stored locally on your device and is not uploaded to our servers. We claim no rights over your user-created content.

You are solely responsible for any content you create, export, or share using our apps.

4. In-App Purchases

Some of our apps offer optional one-time or recurring in-app purchases. All purchases are processed by the platform store (Apple App Store or Google Play Store) and are subject to that store's terms and refund policies.

• ●No refunds from us: We do not process payments directly. For refund requests, contact Apple or Google through their respective support channels.
• ●Restore purchases: If you reinstall an app or switch devices, you can restore previous purchases through the app's settings or the platform store.

5. Intellectual Property

All content, design, graphics, logos, icons, sounds, and code in our apps are owned by Phyx Games or our licensors and are protected by applicable intellectual property laws. These Terms of Use do not grant you any rights to our trademarks, branding, or other intellectual property.

6. Disclaimer of Warranties

Our apps are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• ●Defects will be corrected.
• ●Our apps will meet your specific requirements.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Phyx Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of or inability to use our apps, regardless of the theory of liability.

In no event shall our total liability to you exceed the amount you have paid to us (if any) for the app in the twelve (12) months preceding the claim.

8. Third-Party Services

Our apps may rely on third-party services (such as platform stores and purchase verification providers). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is governed by their respective terms and policies.

9. Termination

We may terminate or suspend your access to our apps at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users or us.

You may terminate your use at any time by uninstalling the app. Upon uninstallation, all locally stored data is deleted.

10. Changes to These Terms

We may update these Terms of Use from time to time. Any changes will be reflected by updating the "Effective Date" at the top of this document. Continued use of our apps after changes constitutes acceptance of the updated terms. We encourage you to review these terms periodically.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these terms or your use of our apps shall be resolved in the courts of competent jurisdiction.

12. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
